This end user license agreement (the "Agreement") should be read by the player ("you") in it's entirety before using our website or service. This agreement constitutes a legally binding agreement between you and BGA Poker Leagues (herein referred to as "us", "we" or "BGA Poker") and the BlockGators Army Advertising Network (herein referred to as "the network" or "BGAN") which operates the websites found at bgapoker.com ("site") and bgapoker.icu. Also please read our Rules relating to the games available on our sites. By clicking the checkboxes upon registration and using this website and software, you consent to the terms and conditions set forth in this Agreement and the Rules as each may be modified or updated at any time.
Our sites and services are provided "as is" and we offer no warranty or representation whatsoever in regards to their accuracy, completeness, fitness for purpose or their quality, that defects will be addressed or corrected or that the sites or services we provide shall be free from contaminants, viruses or bugs. We also make no warranty that the sites will remain uninterrupted, error-free or timely, regardless of our efforts to provide you with the highest quality of service, security and safety.
BGA Poker Leagues reserves the right to remove, add, discontinue, modify or suspend the sites and services in its absolute discretion with immediate effect and without any obligation to provide you with notice where we deem it necessary to do so including (for example) for the maintenance, update or management of the sites or services and we shall not be liable in any way whatsoever for any loss suffered as a consequence of any decision made by us or a third-party in this regard.
You hereby acknowledge that the play chips ("chips" and "points") on our sites are "virtual currencies" or "virtual chips" which hold value and exist on our sites and throughout the network. BGA Token does not compete with "real world" currency. The terms "earn", "win", "buy" or "purchase" as related to these "virtual chips" are only used figuratively and you agree that you have no right or title in these "virtual chips" originating or appearing in any game, no matter if they are "earned", "gifted" or "purchased" from BGA Poker Leagues or any other service we may offer. While using our sites to play games, you have the option to purchase play chips called "chips" (which will appear in your primary balance) as well as use chips received for free ("Free Chips" or "points" which will appear in your secondary balance). You hereby acknowledge that these "virtual chips" called "points" can be used throughout the network and can be redeemed for BGA Tokens or merchandise throughout the network. You also agree that you cannot sell these "virtual chips" to any other player by "chip dumping" them during a game and is punishable by all involved parties accounts being frozen and access to our sites removed for all persons involved. Any balance of "virtual currency" in your account on our sites are not a real-world balances but indicates a stored value within the network (and subject to the network's terms), and instead constitutes a measurement of the extent of your license within the network.
You acknowledge that BGA Poker Leagues allow the purported sale, trade or gifting of "virtual chips" or anything else that originates on our sites within the network. You may not trade, sell or attempt to sell any "virtual chips" outside the network. Any attempt to do so is prohibited and may cause termination of accounts of any parties involved. In addition you acknowledge that we may pursue legal action against you for any harm such a sale, attempted sale, transfer or attempted transfer of "virtual chips" may cause outside of our network.
You may buy a license to use "virtual chips" for valuable consideration on our sites by visiting the purchasing page on our sites as well as providing your account information and re-affirming your agreement to this Agreement as well as affirming the particulars of your purchase. After you purchase "virtual chips" we may send you an email confirming your purchase. Please confirm the details in the email are correct as soon as possible and notify us immediately with any concerns. When you purchase "virtual chips" called "points" from our sites. Your order represents a license for these "virtual chips" which will be accepted by us when we make the "virtual chips" available for use in your account. Your license to use "virtual chips" on our sites and in our games are provided by BGA Poker Leagues and commences upon acceptance of your purchase by us. A purchase of a license to use our "virtual chips" is non-refundable by BGA Poker Leagues.
BGA Poker Leagues reserves the right to adjust pricing for the use of our sites and the "virtual chips" licenses to you through our sites at any time. You acknowledge that BGA Poker Leagues is not required to provide a refund for any reason and that you will not receive "real-world" money or compensation of any kind for "virtual chips" that remain unused or when your BGA Poker Leagues account is closed whether that closure was involuntary or voluntary.
To be clear and to avoid any doubt, it is hereby stated that the purchase of a license to use "virtual chips" on our sites does not entitle you to any rights whatsoever other than those reflected by the license. Furthermore we clarify that your purchased license of "virtual chips" may be transferred, redeemed, sold, bequeathed, leased, rented or otherwise disposed of outside the network in return for valuable consideration.
You agree that you are solely liable for any expenses, costs or damage arising out of or in connection with any unauthorized use of our sites by you. You agree to notify us immediately if you become aware of any other persons unauthorized use and will provide us with reasonable assistance of any investigation we pursue regarding any information in this respect that you may provide.
You acknowledge that by using our sites that you gain no rights to our site content or trade marks, including but not limited to the terms "BGA Poker Leagues", "BGA Poker", the domain names "bgapoker.com" or "bgapoker.icu", and any signs, logos, artwork, pictures, graphics, animations, videos, live streams, audio and text ("site content") without prior written consent.
You agree not to perform any action which may damage the reputation or image of BGA Poker Leagues or harm or potentially harm the rights, including intellectual property rights or trade marks held by BGA Poker Leagues and the network. You agree that any images or names you use in regards to our sites will not infringe the privacy, intellectual property or other rights of any third party. You also agree to grant BGA Poker Leagues irrevocable, royalty free, transferable, sublicense license to use any images and names connected with our sites, subject to the terms of our privacy policy.
We reserve the right to request from you evidence of age to ensure that you are not a minor using our sites at any time. We also reserve the right to cancel or suspend your account and ban you either permanently or temporarily from using our sites if you are unable to provide proof of age or if we suspect you are underage.
We retain authority over the maintenance, issuing and closing of users' accounts on our sites. Any decision by our management in regards to any aspect of a user's account or use of our sites or services or in any dispute resolution, is final and shall not be open to review or appeal.
You accept that we store each hand history on our servers and in the event of a dispute between the cards displayed on your screen and the hand history on our server the hand history on our server shall prevail. The user accepts that the "Replay hand summary" on our sites/services is not considered the official record of any hand.
You represent, covenant, warrant and agree that prior to your use of our sites and services:
The user is prohibited from posting any threats, threatening material, defamatory, libelous, obscene, indecent, racist, unlawful material or any material that would violate any law or be considered to be offensive, via the sites or services be it player images, using our chat on site or on discord or in correspondence with our staff.
These sites and services provided by BGA Poker Leagues are intended solely for personal use and entertainment and not for money and must not in any way be used to create any financial gain or any other pecuniary advantage to you. The user is obligated to update their account details in the event of any changes and the user must provide full and truthful information in regards to all details and information provided to us by the user.
Collusion between players is strictly forbidden be it by sharing hole cards or any other means. We reserve the right to restrict access to our sites and services, restrict the seating and/or prohibit individuals from playing at any particular table or tournament, in addition to other measures, including but not limited to restricting two or more uers from playing together at the same table or in the same tournament. We reserve the right to consider any collusion between individuals, be they players, observers or any third party present on or off our sites, as a material breach of this Agreement and we have the right to immediately terminate a user's account without notice if a user engages or attempts to engage in any such activity, regardless of the outcome of any such attempt. We are under no obligation to return or credit players involved any chips that may be in your BGA Poker account at such time.
We prohibit external player assistance programs tools that provide an "unfair advantage" to players. Any action which goes beyond that which the player or user has personally observed through their own game play or advice on how to play, in real time, or that goes beyond a basic level is considered an "EPA Tool". Anything that gives a player an "unfair advantage" is considered an "EPA Tool". You agree that we can take steps to detect and prevent the use of EPA Tools.
Losing a hand deliberately to another player is called "chip dumping" and it is strictly prohibited. Any users who attempt or participate in chip dumping, even in team up games, while using our sites or services may be permanently banned and their account terminated immediately. We are under no obligation to return or credit players involved any chips that may be in your BGA Poker account at such time.
If any player engages in or attempts to engage in any behavior that we deem to be fraudulent, improper activity or dishonest while using our sites or services, including without limitation, engaging in any of the actions outlined above or any other manipulation of any game, we shall be entitled to take any action we see fit, including but not limited to:
If a user breaches in part or in whole any provisions contained within this Agreement, BGA Poker Leagues without prejudice to any other rights, reserves the right to take any action as it sees fit, including but not limited to terminating this Agreement or any other agreement in place with said user, including blocking the user's access to the sites and services immediately without notice, terminating the users account on the sites and services and/or taking legal action against such user. We are under no obligation to return or credit such a players chips that may be in their BGA Poker account if such a breach occurs.
You agree to fully indemnify, hold harmless and defend BGA Poker and it's staff from and against all claims, damages, losses, costs, expenses and demands, including legal fees and any other charges whatsoever, howsoever caused, that may arise as a result of:
We are not liable for any wasted expenditure, loss of profits, destruction or corruption of data or any other loss which does not directly result from anything we have done wrong even if we're aware of a possibility of such damage occurring.
BGA Poker total liability to you shall be limited to twenty US dollars. This limit does not apply to our liability for personal injury or death caused by our negligence, which shall be unlimited.
Each user agrees that they are solely responsible for creating a strong password in accordance with our sites guidelines upon registration and agrees that they (the user) shall not give their login credentials to any other person whatsoever and shall not permit any other person to use our sites or services.
Users are solely responsible for keeping their login credentials safe and secret at all times and must take necessary precautions to protect said credentials. Unauthorized use of the users login credentials is the sole responsibility of the user and will be deemed as the account holders use. All liability from any such unauthorized use is of and on the account holder themselves.
In the event BGA Poker discovers a user has registered multiple accounts on our sites and/or services we may terminate such accounts without notice. Users may only have one account on our sites and/or services. Multiple accounts by a single individual is strictly prohibited and is grounds for immediate termination without notice. This is considered cheating and we are under no obligation to return or credit such a players chips that may be in their BGA Poker account in such an instance.
You acknowledge that you have no ownership over your account on our sites and/or services and that all rights in and to your account are forever owned by BGA Poker.
Your continued use of our sites and services is deemed to attest to your agreement to any amendments to this Agreement after 14 days of it being posted to our sites or services and you are bound by such amendments to this Agreement. We reserve the right to modify or edit this Agreement in part or in full without notice at any time.
If at any time we offer a waiver of any breach of this Agreement, that in no way shall be taken as a waiver of any future breaches of this Agreement, including but not limited to our failure to require literal interpretation of this Agreement in part or in full in any instance.
The user agrees that there is no partnership, arrangement of trust, joint venture or fiduciary relationship between you, BGA Poker Leagues, and the network.
